These Terms of Use ("Terms") govern your use of overthehump.org and our email newsletter (together, the "Services"), operated by OTH Media LLC ("we", "us", "our") from Ohio, United States. By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Who can use the Services
You must be at least 13 years old to use the Services, and at least 18 to send us a message through the contact form or subscribe to the newsletter. The Services are informational: read about the show, browse events and releases, listen through embedded players, and get in touch with us.
2. Acceptable use
Please don't:
- Copy, republish, redistribute, or commercially exploit our content beyond what Section 5 allows
- Scrape, crawl, or harvest the site's content or code by automated means, apart from ordinary search engine indexing
- Send spam, malware, or unlawful, harassing, or infringing material through the contact form
- Interfere with the site's operation or security, or try to reach parts of it that aren't public
3. Contact form and newsletter
When you send us a message, you agree that we may reply by email. If you subscribe to the newsletter, you're consenting to receive it, and you can unsubscribe at any time using the link in any newsletter email or by emailing us. Our Privacy Policy explains what we do with the information you give us.
4. Event listings and other information
Event listings, schedules, lineups, and links are provided for general information and change frequently. We don't guarantee that any listing is accurate, current, or complete, and we're not responsible for cancellations, schedule or lineup changes, ticket availability, admission decisions, or anything that happens at an event. Always confirm details with the venue or organizer before you go. Nothing on the Services is professional advice; all content is for information and entertainment.
5. Content and intellectual property
Our content. The site's design, original text, logos, and graphics belong to us and are protected by copyright and trademark law. You're welcome to link to and share our pages and to quote short excerpts with attribution. Anything beyond that - copying, republishing, modifying, or commercial use - needs our written permission.
Everyone else's content. Event listings, artwork, photos, music, and embedded media belong to the artists, labels, venues, promoters, and platforms that created them. We don't claim ownership of any of it, and we'll remove or correct material at the rights holder's request. Don't reuse third-party content without permission from whoever owns it.
6. Third-party links and embedded players
The Services link to and embed content from other services, including SoundCloud, Mixcloud, Bandcamp, ticketing sites, and social media. We don't control those services, and their own terms and privacy policies apply when you use them. Featuring or linking to an artist, venue, promoter, or event is not an endorsement, sponsorship, or affiliation in either direction, and we're not liable for loss or damage arising from third-party content or services.
7. Disclaimer
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will be uninterrupted, error-free, or secure.
8. Limitation of liability
To the fullest extent permitted by law, we and our members, officers, and contributors aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising from your use of the Services. Our total liability for any claim relating to the Services won't exceed US $100. Nothing here limits liability that can't be excluded by law, including liability for fraud or for death or personal injury caused by our negligence. Some jurisdictions don't allow certain of these limitations, so parts of this section may not apply to you.
9. Changes to the Services and these Terms
We may change, suspend, or discontinue any part of the Services, and may remove content or restrict access, at any time. We may also update these Terms; the "Last updated" date shows the current version, and continuing to use the Services after a change means you accept it. Provisions that should survive by their nature do survive, including those on intellectual property, disclaimers, and limitation of liability.
10. Copyright complaints
If you believe content on the site infringes your copyright, email contact@overthehump.org and include: what work you own, the URL of the material in question, your contact information, a statement that you believe in good faith the use isn't authorized, a statement that your notice is accurate and that you're the owner or authorized to act for them, and your signature. We'll review it and act promptly, which may include removing the material.
11. Governing law and venue
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. Any dispute must be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of those courts. If you're a consumer in the EU/EEA or UK, this doesn't remove rights you have under your local law, including any right to bring a claim locally.
12. Other terms
If any provision of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, are the entire agreement between us regarding the Services.
